These terms apply to the use of the Finanzpix website, the guide “Let’s talk finance” and the iOS app “Pay-Pulse”. Part A applies to all offerings; Part B (app terms of use) applies additionally to the app.

“Consumers” in these terms are persons within the meaning of § 1 Austrian Consumer Protection Act (KSchG). Deviating terms of users apply only if we expressly agree to them in writing.
A2 · Services
Let’s talk finance is an interactive information and education offering on personal finance. Pay-Pulse is an iOS app that detects and displays recurring payments (subscriptions) from bank statements you import and gives general coaching tips. Where offerings are paid, prices are shown before the contract is concluded (for the app, in the App Store).
A3 · No advice
All content, calculations, examples and tips are for general information and education. They are not investment advice, not an investment recommendation, not tax advice and not legal advice. Calculation examples are simplified models and not forecasts. Past performance is not a reliable indicator of future results. You make investment decisions at your own responsibility. Figures, tax rates and deadlines refer to Austria unless stated otherwise. The provider’s positions shown in the guide are personal examples; the provider holds the ETFs mentioned in their own portfolio.
A4 · Conclusion of contract, prices, payment
You can use the information offering on the website without registration. You obtain the app through the Apple App Store; the contract for using the app is concluded on download or purchase. Payments for paid services and subscriptions are made through your Apple ID under Apple’s terms. You can manage and cancel subscriptions in your Apple ID settings.
A5 · Rights of use and obligations
You receive a simple, non-transferable, non-exclusive right to use the offerings for private purposes. In particular, copying, reselling or publicly making content available, and circumventing technical protection measures are not permitted unless mandatory law allows it. You import into the app only bank statements you are entitled to use.
A6 · Availability and changes
We strive for the most continuous availability possible but cannot guarantee it. We may develop, change or discontinue offerings to the extent this is reasonable for users and does not devalue services already paid for.
A7 · Warranty
The statutory warranty provisions apply, for digital services to consumers in particular the Austrian Consumer Warranty Act (VGG). Mandatory consumer rights remain unaffected. Please report defects via the support page.
A8 · Liability
We are liable under statutory provisions for damage from injury to life, body or health and for intent and gross negligence. Towards consumers we are liable for personal injury in cases of slight negligence; otherwise liability for slight negligence is excluded towards business customers to the extent permitted by law. We accept no liability, to the extent permitted by law, for decisions you make based on the content (in particular investment decisions) or for the content of external links.
A9 · Right of withdrawal for consumers
For distance contracts you may withdraw within 14 days without giving reasons. The period starts when the contract is concluded. A clear statement to the contact address above is sufficient.
For digital content not supplied on a physical medium, the right of withdrawal expires if we have begun performance after you expressly consented and acknowledged that you thereby lose your right of withdrawal (§ 18(1) no. 11 Austrian Distance and Off-Premises Contracts Act, FAGG). For purchases in the App Store, Apple’s refund rules apply additionally.
A10 · Intellectual property
All rights in texts, graphics, calculations, software and trademarks remain with us or the respective rights holders. “Finanzpix”, “Let’s talk finance” and “Pay-Pulse” are designations of the provider.
A11 · Data protection
Information on the processing of personal data can be found in the privacy policy.
A12 · Changes, governing law, jurisdiction
We may change these terms with effect for the future where objectively justified and reasonable; we will inform you of material changes in good time. Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection provisions of the state of their habitual residence remain unaffected; jurisdiction follows § 14 KSchG. For business customers, the competent court at the provider’s registered office has jurisdiction. If individual provisions are invalid, the remainder stays in effect.
B · Pay-Pulse app terms of use (end-user licence agreement)
These terms supplement Part A for the iOS app Pay-Pulse.
B1 · Contracting parties
This agreement is solely between you and us (the provider), not with Apple Inc. (“Apple”). We – not Apple – are solely responsible for the app and its content.
B2 · Scope of licence
We grant you a non-transferable, limited licence to use the app on Apple devices you own or control, subject to the Usage Rules of the App Store Terms of Service.
B3 · Maintenance and support
We are responsible for maintenance and support of the app (see Support). Apple has no obligation to provide maintenance or support services for the app.
B4 · Warranty
If the app fails to conform to the applicable warranty, you may notify Apple, and Apple will refund the purchase price where applicable. Beyond that, Apple has no warranty obligation for the app. Any other claims, losses, liabilities, damages and costs due to non-conformity are our responsibility to the extent permitted by law.
B5 · Product claims
We – not Apple – are responsible for claims by you or third parties relating to the app, including product liability, failure to meet legal requirements and claims under consumer protection or privacy law.
B6 · Third-party rights
If a third party claims that the app infringes their intellectual property rights, we – not Apple – are responsible for investigating, defending, settling and discharging such claims.
B7 · Legal compliance
You represent that you are not located in a country subject to a US government embargo or designated as a “terrorist-supporting” country, and that you are not on any US government list of prohibited or restricted parties.
B8 · Developer

B9 · Third-party terms
When using the app you comply with applicable third-party terms, e.g. your mobile or data plan.
B10 · Third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance, Apple will have the right to enforce this agreement against you as a third-party beneficiary.
B11 · Subscriptions (if offered)
If the app offers subscriptions: payment is charged to your Apple ID upon confirmation of purchase. A subscription renews automatically unless cancelled in your Apple ID settings at least 24 hours before the end of the current period. Price and term are shown before purchase.
B12 · Note on financial information
The app’s analyses and coaching tips are general suggestions and not investment, tax or legal advice (see A3).
